2. About these terms

These Terms of Use govern your access to and use of itsarea.com (the "Site"). By using the Site you accept these terms and agree to comply with them. If you do not agree, you must not use the Site.

These terms apply to the Site only. Our products, including Cost Portal at costportal.itsarea.com, are provided under separate terms made available within those products.

3. Changes to these terms

We may revise these terms from time to time. The revised terms apply from the date they are posted, and your continued use of the Site after that date constitutes acceptance of them. Please check this page periodically.

4. Changes to the Site

We may update and change the Site from time to time. We do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the Site for business or operational reasons.

5. Intellectual property

We are the owner or licensee of all intellectual property rights in the Site and the content published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may view, download for caching purposes only, and print pages from the Site for your own personal or internal business use, subject to the restrictions below. You must not modify the paper or digital copies of any materials you print or download, and you must not use any illustrations, photographs, video or audio sequences, or graphics separately from any accompanying text. The "Area" name and logo are trade marks of ITSAREA LTD and may not be used without our prior written consent.

6. Acceptable use

You must not use the Site:

  • In any way that breaches any applicable local, national or international law or regulation.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards (it must be lawful, accurate, and not defamatory, obscene, offensive or in breach of confidence or third-party rights).
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material, or any other form of similar solicitation (spam).
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
  • To attempt to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer or database connected to the Site, including by reverse engineering, scraping at scale, or interfering with security features.

Subject to the carve-outs above, we will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, the Site, or use of or reliance on any content displayed on it. In particular, we will not be liable for: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

If you are a consumer, please note that we provide the Site for domestic and private use. You agree not to use the Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. Nothing in these terms affects your statutory rights.

We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform to access the Site, and you should use your own virus protection software.

You may link to the Site's home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. We reserve the right to withdraw linking permission without notice.

13. Governing law and jurisdiction

Any dispute or claim arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer resident in another part of the United Kingdom, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.
